The Difference In Charges
Sexual offense charges are rated in four different degrees, rated first through fourth degree, with first-degree offenses being the most severe. The following are examples of crimes and their associated degree of sexual offense in Maryland:
- First degree (felony charges): Committing a nonconsensual sexual act by threat of force, by force or with a weapon. These charges come with a minimum of 25 years in prison up to a conviction of life without parole.
- Second degree: Charges for those who have committed the offense by threat or force against a disabled or handicapped person or committed statutory rape of a minor. These charges come with a minimum of 15 years in prison, with a possibility of up to life.
- Third degree: Non-rape actions that still involve sexual contact without consent, such as molestation. Imprisonment charges cannot exceed ten years for these charges.
- Fourth degree: misdemeanor charges, commonly associated with abusing a position of power with a minor or if the accused is four or more years older than the victim. Can result in up to one year of prison, $1,000 in fines or both. If the convicted person has prior offenses, they can receive up to three years in prison.
