Understanding Maryland’s BUI Penalties

Boating under the influence is covered under Maryland’s operating under the influence (OUI) and operating while intoxicated/impaired (OWI) laws. Under these laws, a boat operator may face serious penalties if convicted. The specific penalties will depend upon the operator’s blood alcohol concentration (BAC) and whether this is a first or subsequent offense.

The following penalties may be imposed for BUI or BWI in Maryland:

  • Boating under the influence per se (BUI or OUI), which involves a BAC result of .08% or greater, carries a fine of up to $1,000, up to one year in jail and the loss of boating privileges.
  • Boating while intoxicated (BWI or OWI), which involves abilities that are impaired by alcohol or drugs, carries a two-month jail sentence, $500 fine and loss of boating privileges.

Enhanced penalties may apply for second or subsequent BUI or BWI convictions.
